三、委托代理合同

Commission Contract

民事委托合同

委托人（甲方）：

甲方与          因离婚纠纷一案，委托*律师事务所为甲方的诉讼代理人，经双方协商，订立下列各条，共同遵照履行：

Party A, hereby authorize * Law Firm, Party B to actas Legal Representative of Party A in the case of divorce between Party A and        . Both Parties agree to enter intoand be subject to the following provisions:

一、乙方接受甲方委托，指派王律师为甲方的诉讼代理人，参与上述案件一审的程序。

Party B accepts the authorization of the Party A andappoints, *Wang, an attorney at law, to be the agent and litem of Party A toparticipate in the procedure of first instance.

二、乙方律师应依法维护甲方的合法权益；但乙方并未承诺该次离婚诉讼一定达到判决离婚等任何效果；如本案系甲方第一次起诉离婚，则签订本合同时，乙方已多次提醒甲方，该次离婚诉讼存在可能被判不利的风险，需要等到第一次诉讼终结六个月后才能进行第二次诉讼。

The lawyer assigned by Party B shall safeguard thelegal rights and interests of the Party A conscientiously, but Party B do notmake any commitment on the result of the lawsuit. If it happened to be thefirst time Party A file a lawsuit, Party B shall remind Party A again and againof the possibility of not granting a decree of divorce, and in this case PartyA is allowed to file an action for divorce again six months after thetermination of the first lawsuit.

三、甲方必须如实地向经办律师陈述案情，提供有关本案的证据。律师接受委托后，发现甲方未如实陈述事实，有弄虚作假行为的，乙方有权中止代理，所收费用不予退还。

Party A shall make an earnest statement of the factand provide relevant evidence to Party B. Where Party A makes up a story orfabricates evidence, Party B may terminate the agency contract withoutreturning the counsel fees collected in accordance with the contact.

四、本合同生效后，任何一方均不能擅自变更、解除合同。如因非乙方原因造成合同不能履行或中止或解除时，甲方所交律师费不予退回。

After the contract becomes effective, no Party canunilaterally modify or rescind the contract. Party B may not return the counselfees collected in accordance with the contract if the contract can’t beperformed or the contract was suspended or rescinded due to any reason otherthan Party B.

五、甲方委托乙方代理权限为：

全权代理。代为起诉、承认、变更、放弃诉讼请求，进行和解，提起反诉或者上诉；代为立案、签收递交各类法律文书、出庭等。

The scope of the authorized power as follows:

Full authority agent. On behalf of the client, Party Bis authorized to sue, admit, alter or waive claims, to mediate, to file acounterclaim or an appeal, to put on record, to receive legal documents, toattend court sessions, etc.

六、根据《广东省律师服务收费管理实施办法》的规定，甲方应向乙方支付下列费用：                                  

In accordance with the relevant provisions of the ImplementationRules of the Guangdong Province on the Administration of Lawyer’s Fee Charges,Party A shall pay Party B RMB                                  

七、本合同的变更和解除须经双方协商一致。未经乙方授权，经办律师不得直接与甲方协商变更或解除本合同。

This contract may be modified or rescinded upon theconsensus of both Parties through consultation. Without authorization, thelawyers aren’t allowed to directly consult with Party A to make the contractmodified or rescinded.

八、本合同有效期自签订之日起至本案一审判决、调解或撤诉时止。

This contract becomes effective from the date ofsigning and shall terminate when the judgment was made or the case was mediatedor the claim was withdrawed.

九、本合同一式两份，甲、乙双方各执一份，具有同等法律效力。

This contract is made out in duplication, and eachParty holds one. Both the two copies are of the same legal force.
